Noordhoek In-Store Easter Competition Terms and Conditions

Promoter

The promoter of this competition is The Pole Yard Ltd, a company registered in South Africa with its registered office at 8 Lakeshore Road, Capricorn Business Park, Muizenberg, 7945 ("The Pole Yard").

Competition Details

The "Noordhoek In-Store Easter Competition" ("Competition") will take place on Saturday, April 12, 2025, at The Pole Yard’s Noordhoek branch, located at [insert exact address if available, e.g., Main Road, Noordhoek, Cape Town]. The event will run from 10:00 to 13:00 (South African Standard Time), unless otherwise notified. Participants are advised to check www.poleyard.co.za for any updates to the operating hours or event details prior to attending.

Eligibility

  1. The Competition is open to all persons legally resident in South Africa who are 18 years of age or older at the time of entry.
  2. The following individuals are excluded from participation:
    • Employees of The Pole Yard Ltd and their immediate family members (spouses, parents, siblings, children).
    • Any person directly involved in the organisation, administration, or judging of the Competition.
  3. Proof of age and residency may be required at registration (e.g., ID document or passport).

Entry Mechanism

  1. Entry is free, and no purchase is necessary to participate.
  2. To enter, participants must visit The Pole Yard’s Noordhoek branch in person on April 12, 2025, during operating hours (10:00–13:00) and register with staff at the designated registration point.
  3. Only the first 100 eligible participants to register will be permitted to spin the prize wheel, with each participant entitled to one (1) spin only.
  4. Multiple entries or attempts to register more than once by the same individual will result in disqualification.
  5. Registration is on a first-come, first-served basis. If fewer than 100 participants register, the Competition will proceed with the available participants, and some prizes may not be awarded.

Prizes

The prizes will be awarded based on the outcome of a wheel spin, with the wheel divided into 100 sections as follows:

  1. 10% Off Voucher: Valid for on the day for April 12, 2025, redeemable at The Pole Yard Noordhoek branch only, and cannot be combined with other offers or promotions.
  2. 1.2M Bench: Delivery will be arranged free of charge to a valid South African address provided by the winner at registration, within 14 days of the event.
  3. Small Planter Box and 300 x 600 Planter Box: Collectable in person at the Noordhoek branch by 13:00 on April 12, 2025.
  4. Prizes are as stated, non-transferable, and no cash or alternative prizes will be offered. The Pole Yard reserves the right to substitute any prize with another of equivalent value without prior notice, subject to availability.

Winner Selection and Notification

  1. Winners will be determined immediately upon spinning the prize wheel, with the outcome indicated by where the wheel stops.
  2. The wheel’s design and operation will be overseen by an independent staff member to ensure fairness and integrity.
  3. For prizes collectable on the day (10% Off Voucher, Small Planter Box, 300 x 600 Planter Box), winners must claim their prize in person by 13:00 on April 12, 2025, or the prize will be forfeited.
  4. For the 1.2M Bench, the winner must provide valid contact details (name, phone number, and delivery address) at registration. If contact details are incomplete or the winner cannot be reached within 7 days of the event, The Pole Yard reserves the right to reallocate the prize.
  5. The Pole Yard’s decision on all matters related to winner selection and prize allocation is final and binding, and no correspondence will be entered into.

Results and Publicity

  1. The names of winners will be available for 28 days from April 13, 2025, on The Pole Yard’s website (www.poleyard.co.za) and at the Noordhoek branch upon request.
  2. By participating, winners consent to the use of their name, likeness, and/or photographs in any publicity material related to the Competition, without additional compensation.
  3. For inquiries or to verify results, contact website@poleyard.co.za.

Personal Information

  1. Personal information collected (e.g., name, contact details) will be processed in accordance with the Protection of Personal Information Act 4 of 2013 (POPIA) solely for the purposes of administering the Competition and, where consent is given, for marketing purposes.
  2. Data will be retained for 6 months following the event and will not be shared with third parties without the participant’s prior consent, except as required by law.
  3. Participants have the right to request access to, correction of, or deletion of their personal information by contacting website@poleyard.co.za.

Liability

  1. The Pole Yard will not be liable for any loss, injury, or damage arising from participation in the Competition, except where such loss, injury, or damage is caused by our gross negligence or willful misconduct, to the extent permitted by law.
  2. The Pole Yard is not responsible for any participant’s inability to attend the event or claim a prize due to personal circumstances.

Cancellation or Amendment

  1. The Pole Yard reserves the right to cancel, suspend, or amend the Competition or these terms and conditions due to unforeseen circumstances beyond its control, including but not limited to natural disasters, civil unrest, or legal restrictions.
  2. Any changes or cancellation will be communicated via www.poleyard.co.za and an in-store notice at the Noordhoek branch at least 24 hours prior to the event, where practicable.

Accessibility

  1. Participants requiring assistance to participate (e.g., due to mobility issues) may contact website@poleyard.co.za by April 10, 2025, to request reasonable accommodations, subject to availability and feasibility.

Governing Law

  1. The Competition and these terms and conditions are governed by the laws of South Africa.
  2. Any disputes arising from the Competition will be subject to the exclusive jurisdiction of the South African courts.

Acceptance of Terms

  1. Participation in the Competition constitutes full acceptance of these terms and conditions.
  2. The Pole Yard’s decision on all matters related to the Competition is final.
